This Privacy Policy applies to the RODHOUSE website (hereinafter referred to as the "Website"). The Website is operated by Rodhouse, 46 rue Iluric, 56370, SARZEAU, France.

In accordance with the applicable data protection laws, RODHOUSE may process data necessary for entering into a contract with you or for taking steps, at your request, prior to entering into a contract (Art. 6(1)(b) of the GDPR). References to the GTC should at all times be understood as information on data processing (Art. 13 and 14 of the GDPR) and never as clauses constituting the GTC. By using the Website and our services, you enter into a legally binding contract with RODHOUSE, the terms of which are described in the GTC.

2.1. We collect and use your personal data to enable you to use our Website, provide our services, and enter into a contract (Terms and Conditions) with you, particularly to facilitate commercial transactions through the Website, use the electronic payment system, or leave reviews. To use these services, you need to have a RODHOUSE account. To that end, you must register as a member on the website.

We require most of your personal data to enter into a contract (Terms and Conditions) with you. If you do not provide us with this personal data, we will not be able to enter into or fulfill a contract (Terms and Conditions) with you. We need some of your data to comply with our legal obligations when you are a member of our Website. If you do not provide us with this personal data, we will not be able to meet legal requirements and provide our services.

These data are also used to improve the Website so that we can offer a better experience to our members (see 2.2.12).

RODHOUSE transfers or shares personal data with service providers only to the extent necessary and permitted under applicable law. Additionally, we designate the following service providers who, therefore, receive personal data as data recipients.

We continuously conduct and improve the technical maintenance of the Website to protect the security and confidentiality of the personal data we process and perform certain business-related functions that contribute to making our services available and functional. For this reason, we transfer your profile data to service providers who provide cloud and hosting services, IT security, maintenance and technical services, and communication services:

We transfer personal data to lawyers, legal assistants, notaries, bailiffs, auditors, accountants, debt collectors, consultants, translation agencies, IT service providers, insurance companies, and archiving services that provide services to RODHOUSE.

Furthermore, we share data within the RODHOUSE group. Data processed within the RODHOUSE group is transferred to RODHOUSE, to the extent necessary for the management of the RODHOUSE group.

RODHOUSE is legally obligated to provide personal data and/or usage data to authorities responsible for investigations, criminal prosecution, or surveillance, if and to the extent necessary to prevent risks to the public and for the prosecution of criminal acts.

RODHOUSE may share your data with third parties when transferring the obligations and rights relating to the contractual relationship between you and RODHOUSE to such third parties, in accordance with the Terms and Conditions, particularly in the case of transferring a business sector, forming a new company through a merger, absorption merger, division, or any change of control involving RODHOUSE. Prior to such an event, RODHOUSE will separately inform you about the information regarding the sharing of your data and obtain your consent when legally required.

7.1. What are your rights? Subject to the conditions, restrictions, and exceptions established by the legal provisions on data protection, you have the right at any time to:

  • Demand the correction of inaccurate data and, subject to the nature of the collection and use, the completion of incomplete data (right to rectification). You can also modify all the data you have directly provided to us on the Platform (2.1, 2.5, and 2.6) at any time through your RODHOUSE account (excluding sent messages and forum posts or comments).
  • Demand, with just cause, the deletion of your data (right to erasure).
  • Demand the restriction of the collection and use of your data, provided that the statutory criteria are met (right to restrict processing).
  • Receive, provided that the statutory criteria are met, the data you have provided in a structured, current, and machine-readable format, and transfer such data to another data controller or, where technically feasible, have RODHOUSE transfer the data (right to data portability).
  • Object to the collection and use of data, solely when such collection and use are based on a task carried out in the public interest or in the exercise of official authority (Art. 6(1)(e) of the GDPR) or for legitimate interests (Art. 6(1)(f) of the GDPR), including profiling, based on the same grounds of data collection and use explained in other sections of this statement (right to object). You also have the right to object, at any time, to the collection of your personal data for direct marketing purposes.
  • Withdraw any consent you have provided at any time. Such withdrawal will not affect the lawfulness of the collection and use carried out prior to the withdrawal based on the granted consent. You can withdraw your consent regarding the sending of our newsletter by adjusting the settings in your RODHOUSE account to block the sending of any further marketing emails. Alternatively, you can click on "Unsubscribe" at the end of the marketing email.
  • Not be subjected to discriminatory treatment while exercising your rights.

To exercise any of the rights specified in this section, you can contact RODHOUSE and submit your request using the contact details (refer to Section 8 below). In addition to any other legal remedies, you also have the right at any time to lodge a complaint with the supervisory authorities.

Your request must provide sufficient information that allows us to reasonably verify that you are the person or authorized representative of the person whose personal data we have collected (first name, last name, URL of your public profile, email address, other information we may request for verification purposes), describe your request with sufficient information that allows us to understand it, evaluate it, and respond to it appropriately, and confirm, under penalty of sanctions, that you are the person whose personal data is the subject of the request.

If your request is submitted by an authorized representative, a written authorization and information verifying the representative's identity must be included in the request. We cannot provide you with information or enforce any other right you have if we cannot verify your identity or your right to request and confirm the information concerning you.
